Denver Public Schools (DPS) has filed a federal lawsuit against the Trump administration, making it the first school district in the U.S. to legally challenge a new policy that permits Immigration and Customs Enforcement (ICE) agents to operate within schools. The lawsuit, filed on Wednesday, argues that the policy has forced the district to shift resources away from education to address safety concerns and legal uncertainties. 

As Colorado’s largest public school district, DPS asserts that the policy change has had a chilling effect on school attendance, particularly among immigrant students. The district states that many students are reluctant to attend school due to fears of potential immigration enforcement on school premises. 

Impact on Students and School Resources 

According to the lawsuit, the presence of ICE agents in schools has severely disrupted the district’s ability to provide a safe and supportive learning environment. School officials argue that resources meant for educational programs have instead been redirected toward developing safety protocols, training staff, and ensuring students are protected from possible immigration enforcement actions. 

The lawsuit highlights that DPS serves more than 90,000 students, with around 4,000 of them being immigrants. Over half of the student population is of Hispanic or Latinx descent, making the issue particularly pressing for the community. The district claims that the policy shift contradicts the long-standing principle that schools should be safe spaces for all students, regardless of immigration status.

The Trump administration’s recent decision to remove restrictions on immigration enforcement in sensitive locations – including schools – has sparked significant concerns among educators, community leaders, and civil rights groups. The administration’s move is part of a broader effort to fulfill campaign promises related to immigration enforcement and deportations. 

Denver, a city that has seen a sharp increase in migrants in recent years, has been particularly affected by this policy shift. Since 2023, approximately 43,000 migrants have arrived in the city from the U.S. southern border. This influx has put additional pressure on local services, including public schools, which have been working to integrate newly arrived students into the education system. 

District’s Legal Argument Against DHS 

The lawsuit names the Department of Homeland Security (DHS) and its Secretary, Kristi Noem, as defendants. DPS contends that the administration failed to provide a valid justification for lifting the previous protections and did not adequately consider the consequences of the policy change. 

Furthermore, the school district is demanding greater transparency from DHS, particularly regarding the details of the policy. DPS argues that the lack of publicly available information has hindered its ability to properly prepare and respond to the new enforcement measures.
