A federal district court judge temporarily blocked President Donald Trump’s controversial executive order on birthright citizenship on Thursday, January 23, 2025. This ruling marks the first round in what is expected to be a lengthy legal battle over the administration’s efforts to reshape long-standing immigration policies. 

Senior U.S. District Judge John Coughenour, presiding over the case, heard arguments for 25 minutes before delivering his decision. Calling the executive order “blatantly unconstitutional,” Judge Coughenour issued a temporary restraining order that halts the policy for 14 days. The ruling came swiftly from the bench, highlighting the urgency of the matter. 

The Court’s Findings 

The court’s decision to block the executive order was based on the significant harm it would cause states and individuals if allowed to take effect. Key findings cited in the ruling included: 

  1. Irreparable Harm to States and Residents

States challenging the order argued that its implementation would lead to significant financial and logistical burdens. Federal funding for critical services, including healthcare and public benefits, would be jeopardized, while state agencies would face increased costs to support children stripped of citizenship rights. Residents would be at risk of deportation, family separation, and loss of access to vital benefits, such as healthcare and education. 

  1. Immediate and Ongoing Damage

The court found that the executive order would cause significant, immediate, and ongoing harm. These issues could not be adequately addressed through the normal course of litigation, necessitating immediate intervention. 

  1. Constitutional Concerns

The states argued, and the judge agreed, that the executive order violated the 14th Amendment of the Constitution. This amendment guarantees citizenship to all children born on U.S. soil who are subject to its jurisdiction, a principle that has been a cornerstone of U.S. law for over a century. 

The Arguments 

Democratic-led states emphasized the executive order’s profound impact on children and families. Denying citizenship to children born in the U.S. would strip them of fundamental rights and opportunities, with long-lasting consequences. These children would lose access to federal benefits that prevent poverty and promote health, education, and economic stability. 

The states also argued that their own programs would be overwhelmed, as children without citizenship would lose federal support, leaving states to pick up the tab for essential services. Attorneys representing the states emphasized that these financial and logistical burdens were unfairly being shifted onto local governments. 

Meanwhile, the Trump administration defended the order by citing a specific clause in the 14th Amendment, which grants citizenship to those “subject to the jurisdiction thereof.” The administration argued that this language excludes children of undocumented immigrants and certain other non-citizens, making the order lawful. 

At a press conference on Thursday, President Trump vowed to contest the ruling, signaling the new administration’s determination to see the policy enacted. 

What to Expect 

A preliminary injunction hearing is expected in the coming days to determine whether the executive order will remain blocked while the case continues. The stakes are high, with constitutional principles, children’s futures, and state resources hanging in the balance. 

This ruling sets the stage for a heated debate that could reach the Supreme Court and shape the future of birthright citizenship and immigration policy in the United States.
