Judge Orders Evidence Preserved After Border Patrol Killing in Minneapolis

Judge Issues Emergency Order After Minneapolis Border Patrol Shooting

A federal judge has stepped in after a Border Patrol agent killed a Minneapolis ICU nurse, ordering the Department of Homeland Security to preserve all related evidence. The emergency ruling intensifies scrutiny of federal immigration enforcement tactics as legal challenges mount over transparency, accountability, and the expanding federal presence in the city.

Federal Judge Issues Emergency Order Against DHS

A U.S. District Court judge has granted a temporary restraining order barring the Department of Homeland Security from altering, destroying, or withholding evidence tied to the fatal shooting of Alex Jeffrey Pretti in Minneapolis. The order shows growing judicial concern over how federal agencies handle evidence during increased immigration enforcement operations.

The ruling follows reports that state and local authorities faced resistance when attempting to access the scene and secure materials necessary for an independent investigation.

Fatal Shooting Escalates Scrutiny of Federal Operations

Pretti, a 37-year-old intensive care nurse at the Minneapolis VA hospital, was killed during an encounter with a Border Patrol agent. The incident happened less than three weeks after another deadly shooting involving federal immigration officers in the city. This raised public concern about the swift increase in enforcement actions.

The death has raised questions about how federal agencies use force and the oversight of large-scale immigration operations in residential areas.

Video Footage Becomes Central to Legal Review

Video recordings examined by investigators show Pretti holding a cellphone when the shots were fired, with no visible weapon in his hands. Additional footage seems to show a federal agent coming out of a physical confrontation with a gun just before the shooting.

These recordings are now key to the ongoing court proceedings. Judges and investigators are looking into whether federal protocols were followed and if early government accounts match the available evidence.

State Authorities Raise Concerns Over Access and Oversight

Minnesota officials reported delays and difficulties accessing the shooting scene, even after obtaining a valid judicial search warrant. State investigators returned to the area to gather additional evidence and interview witnesses after the city’s leadership intervened.

The Minnesota Attorney General has indicated plans to pursue court action to limit the ongoing surge in immigration enforcement. Meanwhile, the City of Minneapolis is seeking its own legal remedies to pause federal operations.

Legal Challenges Expand Beyond a Single Incident

The court’s involvement has put the Minneapolis enforcement operation under closer legal scrutiny. Multiple lawsuits are now challenging the scope, conduct, and accountability of federal immigration actions. Judges are increasingly being asked to define the boundaries of federal authority when enforcement activities overlap with constitutional protections and public safety issues.

Legal observers say the case could shape how future immigration operations are conducted in cities nationwide.
