DHS Releases List of Countries Eligible for H-2A and H-2B Visa Programs  

The U.S. Department of Homeland Security (DHS), in collaboration with the Department of State (DOS), has announced the updated list of countries eligible for participation in the H-2A and H-2B visa programs for the year 2025. These programs allow U.S. employers to recruit foreign nationals for temporary agricultural (H-2A) and non-agricultural (H-2B) jobs.  

The new list, effective Nov 8, 2024, includes Belize, confirming the lift of the 5-year ban and expanding opportunities for nationals of that country to participate in both H-2A and H-2B programs. The eligibility of countries is reviewed annually, and each designation is valid for 12 months. This update underscores the commitment of the DHS and DOS to ensuring compliance with visa regulations while supporting U.S. labor needs. 

List of Eligible Countries  

For 2025, the list includes about ninety countries spanning continents such as North America, Europe, Africa, and Asia. Examples include:  

  • North America: Mexico, Honduras, Jamaica.  
  • Europe: France, Germany, Lithuania.  
  • Asia-Pacific: Philippines (H-2B only), Mongolia (H-2B only), Australia.  
  • Africa: South Africa, Madagascar, Mauritius.   

Criteria for Country Eligibility  

Countries are evaluated based on their compliance with visa program requirements. Factors influencing eligibility include but are not limited to visa overstay rates, incidences of fraud or abuse, and alignment with U.S. interests in the administration of the programs.  

Countries not included in the eligible list may still have individuals considered for these visas on a case-by-case basis if it is deemed to benefit the U.S.

How This Affects Current H-2 Visa Holders  

The new list does not impact the status of H-2 visa holders already in the U.S. unless they apply to extend their stay based on petitions filed after November 8th, 2024. Similarly, the notice does not affect previously approved petitions or individuals applying for visas based on earlier approvals.
